FGW Media, Ltd., (“Fit Girls”) takes your privacy seriously. We want you to know how we collect, use, share, and protect your personal information. 

This Privacy Policy tells you:

  • What personal information we collect
  • How we use that information
  • How we share that information
  • How we protect that information
  • Your choices regarding your personal information

This Privacy Policy applies only to personal information that we collect on the websites www.fitgirls.com, www.fitgirlsguide.com, and www.fitgirlsworldwide.com as they may be modified, relocated and/or redirected from time to time (the “Site”) and through the Fit Girls mobile application (the “App”) (collectively the “Fit Girls Platform”). 

If you do not want us to handle your personal information as described in this policy, please do not use the Fit Girls Platform. Personal information is information that could reasonably be used to identify you individually, such as your name, e-mail address, and mobile number.

The Fit Girls Platform is intended only for users who are 18 years of age or older and only for a U.S. audience. Any information you provide, including any personal information, will be transferred to and processed by a computer server located within the United States and will be handled in accordance with this policy and U.S. law, which may be less stringent than the law where you reside.

WHAT PERSONAL INFORMATION WE COLLECT

a) Information You Give Us

We collect personal information that you voluntarily share with us through the Fit Girls Platform. For example, we collect information from you when you create an account or fill out a request form on the Fit Girls Platform. 

The information we collect from you may include:

  • Contact information, including name, email address, and telephone number
  • The products and services you order through the Fit Girls Platform
  • Billing information including first name, last name, and billing address
  • Search requests entered into the Fit Girls Platform search function
  • Content posted on the Fit Girls Platform including photograph, name, and your fitness story
  • Instagram account number
  • Messages users provide Fit Girls
  • Responses to surveys, such as, for example, product feedback
  • Information you submit to participate in contests

You may also submit credit card information including credit card number, name on card, expiration date, CVV, gift card, and discount code into the Fit Girls Platform. However, this information is transmitted via Secure Sockets Layer (SSL) encryption to third-party payment processors and is not stored on Fit Girls’ servers. 

b) Information We Collect Through Technology On The Site

We collect information through technology to enhance our ability to serve you. When you access and use the Site, Fit Girls and, in some cases, our third-party service providers collect information about how you interact with the Site. We describe below a few of the methods we use to collect information through technology.

When you visit the Site, we collect your device identifier, browser information, and Internet Protocol (IP) address. An IP address is often associated with the portal you used to enter the Internet, like your Internet service provider (ISP), company, association, or university. While an IP address may reveal your ISP or geographic area, we cannot determine your identity solely based upon your IP address. We do not link your personal information to device identifier information, browser information, and IP addresses.

Do We Use Cookies?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. We use cookies to help us understand and save your preferences for future visits to the Site. For example, when you return to the Site after logging in, cookies provide information to the Site so that the Site will remember who you are.

If you prefer, you can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off cookies by adjusting your browser settings. Like most websites, if you turn your cookies off, some of the features on the Site may not function properly.

Google Analytics

We use cookies provided by Google Analytics, a third-party service provider, to assist us in better understanding our Site visitors. These cookies collect data tied to a user’s IP address such as the length of time a user spends on a page, the pages a user visits, and the websites a user visits before and after visiting the Site. Based on this information, Google Analytics compiles aggregate data about Site traffic and Site interactions, which we use to offer better Site experiences and tools in the future. Web Beacons

We include small graphic images or other web programming code, called web beacons (also known as "pixel tags", “web bugs” or "clear GIFs"), on the Site. The web beacons are minute graphics with a unique identifier. They are used to track the online movements of Web users. In contrast to cookies, which are stored in a user's computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence.

Your ‘Do Not Track’ Browser Setting

We support the Do Not Track (DNT) browser setting. DNT is a preference you can set in your browser’s settings to let the websites you visit know that you do not want the websites collecting your personal information.

We do track your online activities over time and across third-party websites or online services. For example, we use web beacons to help us determine what links or advertisers brought you to our Site. We then track your activities on our Site. We also use web beacons to track your visits to other websites so that third-party service providers can display Fit Girl advertisements to you on those other websites based on your activities while on the Site (“remarketing”).

c) Information Collected by Mobile Applications

When you use the App, we may collect the following information, if you choose to provide this information to the App:

  • Full name
  • The date you joined the Fit Girls community
  • Email address
  • Height
  • Starting weight
  • Whether you adhered to the program in a Fit Girls fitness guide

We may collect information about how you use the App, such as the amount of time you spend using the App, how many times you use a specific feature of the App over a given time period, how often you use the App, and actions you take in the App (collectively “App Usage Information”). We may link your App Usage Information to personal information you have provided us, in which case we will treat the combined information as personal information.

d) Information Third Parties Provide About You

We may supplement the information we collect about you through the Fit Girls Platform with records received from third parties in order to enhance our ability to serve you, to tailor our content to you, and to offer you information that we believe may be of interest to you. For example, websites on which we have placed advertisements may tell us which ads about Fit Girls you clicked. This is often called “conversion tracking.” If you are a Facebook user, Facebook may share with us personal information about you, such as, for example, your name.

In addition, if you log into the App through a social networking site, such as Facebook, we may collect your Facebook authentication token, account identification number and use that information to provide you with access to your account on the Fit Girls Platform. Facebook may also provide us with additional personal information when you log in from Facebook, to the extent this information is available to Facebook.

e) Information You Provide To A Third Party

The Fit Girls Platform includes links from the Fit Girls Platform to and plug-ins (such as Twitter buttons) from sites or applications operated by third parties (“Third-Party Sites”). Fit Girls does not control any Third-Party Sites and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by its privacy policy. It is your choice to enter any Third-Party Site. We recommend that you read its privacy policy if you choose to do so.

HOW WE USE THE PERSONAL INFORMATION WE COLLECT

We use the information we collect to serve our customers and improve your experience on the Fit Girls Platform. Some examples include:

  • Emailing products (e.g., Fit Girls guides) to users
  • Responding to questions
  • Emailing information to users about our products, services, and promotions
  • Sending text (SMS) messages regarding Fit Girls products and services to users who have consented to receive such messages as described in the Terms of Use HERE
  • Unsubscribing users from email lists and from text (SMS) message lists
  • Addressing complaints
  • Sharing users’ photographs and stories
  • Improving Fit Girls’ products and services
  • Responding to questions and feedback
  • Conducting research and analysis
  • Marketing and advertising products and services
  • Continuously evaluating and improving the online user experience

Data Retention

We will retain your personal information until you request that we delete it as described in the “Your Choices Regarding Personal Information We Collect” section below.

HOW WE SHARE THE PERSONAL INFORMATION WE COLLECT

We do not sell your personal information to third parties. The following are some of the ways we share your information:

  • Third-Party Service Providers: We will share your personal information with third-party service providers under contract with Fit Girls to help us provide services to you. The following are some examples of the types of third-party service providers with which we share your personal information and the our purpose for doing so:
    • Data Analytics: We retain third-party service providers to help us perform data analytics regarding your interactions with the Fit Girls Platform. For example, Google Analytics may track what pages users visit on the Site and how long they stay there to determine how users use the Site.
    • Legal Advice: We may disclose your personal information to an attorney in the process of obtaining legal advice.
    • Third-party payment processors: We transmit your payment information to third-party payment processors such as Shopify.
    • Advertising Platforms: We may disclose the fact that you visited the Fit Girls Platform to advertising networks or to other online platforms such as Facebook so that they can show you Fit Girls advertisements on other websites and platforms.

We require these third-party service providers, by written agreement, to provide safeguards for your personal information similar to the ones that we provide.

  • Promotions: We may offer sweepstakes, contests, and other promotions (any, a "Promotion") through the Fit Girls Platform that may require providing personal information to register. By participating in a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements of you, including, allowing the sponsor of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion. Please read the official rules carefully. If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners’ list.
  • Social Network Site Authentication: If you choose to log into the App through a social networking site, such as Facebook, we may share information about your account on the App with the social networking site.
  • Required Disclosures: We may be required to share personal information in response to a court order, subpoena, civil discovery request, other legal process, or as otherwise required by law.
  • Legal Compliance and Protections: We may disclose account and other personal information when we believe disclosure is necessary to comply with the law or to protect the rights, property, or safety of Fit Girls, our users, or others. This includes exchanging personal information with other companies and organizations for fraud protection and credit risk reduction.
  • Corporate Transactions: We reserve the right to disclose and transfer your information, including your personal information:
    • To a subsequent owner, co-owner, or operator of the Fit Girls Platform or successor database.
    • In connection with a corporate merger, consolidation, the sale of substantially all of our membership interests and/or assets or other corporate change, including to any prospective purchasers. 

CHILDREN’S ONLINE PRIVACY PROTECTION ACT COMPLIANCE

We do not collect any information from anyone under 13 years of age. The Fit Girls Platform, products and services are all directed to people who are at least 13 years old or older. If you are under the age of 13, you are not authorized to use the Fit Girls Platform.

CALIFORNIA ONLINE PRIVACY PROTECTION ACT COMPLIANCE/YOUR CALIFORNIA PRIVACY RIGHTS

California residents who use the Fit Girls Platform may request that we provide certain information regarding our disclosure of your personal information to third parties for their direct marketing purposes. The security and confidentiality of your personal information is important to us. We have technical, administrative, and physical security measures in place to protect your personal information from unauthorized access or disclosure and improper use.

For example, we use SSL encryption to protect the data collection forms on our website. In addition, access to your personal information is restricted in our offices. Only employees who need the personal information to perform a specific job (for example, a customer service representative) are granted access to personal information. Employees with access to personal information are kept up-to-date on our security and privacy practices.

It is important for you to protect against unauthorized access to your password and to your computer. Be sure to log out of your account or to close your browser after you have completed your visit to the Fit Girls Platform.

Please note that despite our reasonable efforts, no security measure is ever perfect or impenetrable, so we cannot guarantee the security of your personal information.
